Buying Off-Plan Property in Abu Dhabi: 2026 Guide

Buying off-plan in Abu Dhabi means purchasing a property before construction is complete, usually directly from a developer under a Sale and Purchase Agreement. Buyers often choose off-plan for staged payment plans, access to units at launch and a wider choice of layouts or positions within a project. The trade-off is that you are committing before you can inspect the finished home, so completion timing, final specifications, developer performance and future market values all matter.
Abu Dhabi regulates off-plan sales through project registration, escrow accounts and registration of the buyer's interest before completion. For most of the emirate these processes sit within the ADREC and DARI framework under Law No. 3 of 2015, as amended. Al Reem Island and Al Maryah Island fall within ADGM's real-property jurisdiction and use the separate AccessRP framework. Before paying a substantial instalment, verify the developer, project, escrow account, SPA and registration route that apply to the specific unit.

How Abu Dhabi regulates off-plan property
Abu Dhabi's main legal framework for off-plan development is Law No. 3 of 2015 concerning regulation of the real-estate sector, materially amended by Law No. 2 of 2025, together with its implementing decisions (including the 2025 decisions on escrow disbursement and buyer default). ADREC oversees the onshore system, while DARI provides many of the digital services used for project, transaction and ownership records.
A developer cannot simply market an unregistered building and collect unrestricted buyer payments. The project must pass the relevant registration and approval process, and an off-plan project must have a dedicated project escrow account before units are sold. The account trustee is an ADREC-accredited bank or financial institution, and buyer payments for the project are deposited into that regulated account rather than being treated as the developer's general operating funds.
Off-plan dispositions are recorded in the Initial Real Estate Register. ADREC's current developer journey also states that every off-plan sale is registered through its SPA. At completion, after the required project and unit registration steps have been completed, ownership moves from the initial register into the final Real Estate Register.
The position is different on Al Reem Island and Al Maryah Island. ADGM introduced its own Off-Plan Development Regulations and AccessRP platform following the expansion of ADGM's jurisdiction. AccessRP covers matters including project registration, trust accounts, off-plan sales and transfers, so a Reem Island buyer should follow the ADGM route applicable to that project rather than assuming every DARI procedure applies.
What the escrow account actually protects
Escrow is one of the main protections in an Abu Dhabi off-plan purchase. The project has a dedicated regulated account into which buyer payments are deposited, and withdrawals are limited to permitted project purposes under ADREC's controls and verified construction progress; since 2025 (Decision No. 24 of 2025) a release before 20% completion is possible only against a qualifying bank guarantee. ADREC also allows buyers who have deposited money to obtain information relating to their payments from the account trustee.
That reduces the risk of buyer money being freely used for unrelated purposes, but escrow does not make an off-plan purchase risk-free. Construction can still be delayed, specifications can become disputed and market values can fall. If a development cannot be completed, Abu Dhabi law provides procedures intended to preserve depositors' rights and deal with remaining escrow funds, but the result depends on the project's circumstances and the amounts still available.
Before transferring money, confirm the project's registered escrow details through ADREC or DARI and make sure the beneficiary information on the payment instruction matches the official project account. Do not send substantial project instalments to a broker's account or an unrelated company account simply because somebody describes the payment as part of the payment plan.
The buying process step by step
Start by comparing the project rather than the payment plan. Check the developer, location, expected completion, unit type, layout, ownership right, surrounding construction and likely use of the property. Once you select a unit, the developer will normally issue a reservation or booking form and request an initial payment. Since February 2026, expressions of interest for new projects must be registered digitally through Madhmoun and the EOI money placed in a government-managed preparatory escrow account, so a request to pay a launch deposit into a company account is a warning sign. Read the booking terms before paying because they should explain whether the amount is refundable, when the SPA must be signed and what happens if you do not proceed.
The SPA is the main contract. After execution, the sale is registered in the applicable initial or off-plan property register. For standard DARI transactions, the current published off-plan unit registration charge is 2% of the sale price plus an AED 400 electronic administrative services fee excluding VAT as of 2026. Confirm the current amount and who is contractually responsible for paying it with DARI or ADREC before signing.
You then make the agreed instalments into the project escrow account as they fall due. Near completion, the developer will arrange the handover process. Buyers should inspect the finished unit, record defects during snagging, confirm outstanding payments and documentation, and complete the final registration process that results in the completed property being registered in the buyer's name.
How off-plan payment plans work
There is no single Abu Dhabi payment-plan structure: DARI's process simply provides for full payment or instalments. In the market, some plans spread instalments through construction, around contractual dates or construction milestones; others leave a larger balance for completion; and a post-handover plan allows part of the price to be paid after delivery. These are features a developer may offer, so verify the actual schedule in the project price sheet and SPA.
The important comparison is the total purchase price, not how small the monthly or quarterly instalment looks. A developer may offer different prices or incentives for different payment schedules, so ask for the total amount payable under the plan and compare it with any alternative cash or shorter-term price. A longer or more convenient payment plan is financing value supplied by the developer and should not automatically be treated as free.
Also check whether the payment dates are fixed calendar dates or connected to actual construction progress. Abu Dhabi's legal framework links buyer payments to construction progress unless another arrangement is agreed with the developer, so the wording of the SPA matters. Keep every escrow receipt and reconcile it against the developer's statement.
What to check carefully in the SPA
Read the SPA before treating the reservation as a finished purchase. The most important clauses are the promised completion date, any contractual grace period, what constitutes permissible delay, and the remedies available if either the developer or buyer defaults. Do not assume that a delayed handover automatically creates a right to cancel or receive a fixed amount of compensation; the contract and applicable regulations need to be read together.
Check the unit description, floor plan, parking allocation, agreed area and the developer's ability to alter layouts, materials or specifications. Abu Dhabi law contains rules dealing with differences between contracted and final unit areas, but the legal consequences depend on the size and nature of the difference. If the area or a particular specification is commercially important to you, make sure it is documented clearly rather than relying on a sales conversation.
The SPA should also be reviewed for estimated service charges, purchaser default provisions, late-payment consequences, assignment or resale restrictions, developer NOC requirements and any administrative charges connected with a later transfer. If the booking form or sales representative refers to a cooling-off period, refund right or special cancellation arrangement, ensure it appears in the written documents. We found no general statutory cooling-off period in the official sources; rely only on a right written into the booking form or SPA. Can you resell an off-plan property before handover?
Often yes, but not simply by signing a private contract with another buyer. A registered off-plan interest can be transferred or assigned subject to the applicable registration rules, the SPA and the developer's requirements. The developer may require an NOC and may, by contract, require the existing purchaser to have paid a certain portion of the price before approving an assignment; no emirate-wide minimum percentage exists.
Minimum-payment requirements vary by developer and project, so there is no single percentage that should be assumed across Abu Dhabi. Check the assignment clause before buying if you may need to exit early. Also ask about NOC procedures, developer administration charges, outstanding instalments and the registration process for the incoming buyer.
A resale can be harder if the project's market price has fallen or if competing unsold developer inventory is available on better payment terms. Conversely, a rising market does not guarantee that the developer will permit an immediate transfer. Treat assignment flexibility as a contractual issue rather than assuming an off-plan unit is as liquid as a completed property.
Off-plan fees and VAT
The purchase price is only part of the budget. For a standard DARI off-plan ownership registration, the currently published fee as of 2026 is 2% of the sale price, plus an AED 400 electronic administrative services fee excluding VAT. Developer administration charges are separately regulated. Administrative Decision No. 183 of 2017 states that a developer may not collect registration or other disposition-related fees, while allowing administrative fees received from a third party up to a maximum of AED 5,000. As of 2026, confirm how the rule applies to the specific fee being requested with ADREC before paying it.
Brokerage commission may also apply if it forms part of the transaction and brokerage agreement: for ADREC-jurisdiction transactions Administrative Decision No. 183 of 2017 sets the sale-and-purchase commission at 2% of the contract, capped at AED 500,000, and the brokerage contract determines who pays. Ask whether the developer is paying the broker or whether any commission is due from you before reserving the unit.
VAT treatment depends on the type of property and transaction. For residential property, the Federal Tax Authority currently states that the first supply of a newly completed residential property by sale or lease within three years of completion is zero-rated for VAT as of 2026. This is a federal tax rule rather than an off-plan registration discount, and tax treatment can change, so confirm the position for the specific transaction with the Federal Tax Authority or a tax adviser.
Mortgages, overseas buyers and the Golden Visa
Off-plan property can be financed in some circumstances, but lender appetite varies substantially by developer, project and construction stage. Abu Dhabi law permits the buyer's contractual right in an off-plan unit to be mortgaged where the unit is registered in the Initial Real Estate Register and the lender pays the financed amount directly into the project escrow account. That does not mean every bank will lend on every project, and the Central Bank caps the loan-to-value for any off-plan purchase at 50%, so expect at least half the price in equity; banks may lend less or decline a project. Overseas buyers can purchase qualifying property in Abu Dhabi's designated investment areas, subject to the ownership rights available for the development and the buyer meeting registration requirements. The DARI regulations also provide for identification documents for purchasers resident outside the UAE. Make sure the developer records your passport and contact details correctly and ask how remote signing, powers of attorney or identity verification will be handled before sending funds.
Do not buy an off-plan property solely because a salesperson says it will produce a Golden Visa. Abu Dhabi's official route (ADRO) accepts an approved-developer SPA together with proof that at least AED 2 million has actually been paid, and mortgaged property only where your equity net of the loan is at least AED 2 million, while ICP's federal overview still speaks of property without loans; a contract price above AED 2 million is not enough on its own. Common off-plan mistakes
A low initial payment can make an expensive property appear more affordable than it is. Work from the full contract price and map every instalment against your expected cash flow, particularly the larger amounts due close to handover.
Do not choose solely from renders or a show apartment. Confirm the contractual unit plan, orientation, floor, view description, parking, usable layout and the developer's permitted specification changes. Likewise, do not rely on verbal promises about guaranteed rent, resale prices, handover dates or visa eligibility unless the relevant commitment is documented and capable of being verified.
Finally, verify the project and escrow account, register the SPA properly, keep payment records and budget for ownership after handover. If the property is being bought as an investment, compare expected rent and ongoing costs rather than assuming that buying at launch automatically means a profit.

Abu Dhabi's framework also provides mechanisms for developer delay (ADREC may impose a delay penalty once handover is more than six months beyond the officially expected delivery date, unless the delay was beyond the developer's control), and Law No. 2 of 2025 with Decision No. 165 of 2025 now prescribes the notice, settlement, cancellation, compensation and refund framework when a buyer defaults; a late date does not automatically mean an immediate refund or cancellation. Keep the developer's notices and construction updates and seek advice from ADREC or a property lawyer if a material delay develops.
Can I sell my off-plan property before it is completed?
